Terms of Use

These conditions govern access to Saratoga County Criminal History. Reading a page, submitting a query, or otherwise using the site signifies agreement with every term below. Anyone who does not agree must stop using the site.

NO FCRA USE. Saratoga County Criminal History is privately operated and has no connection to Saratoga County, New York State, or any government body. Neither the site nor its advertising partners offers a service for credit, employment, insurance, tenant screening, or another purpose regulated by the Fair Credit Reporting Act (FCRA). This is a records reference, not a private investigation firm or consumer reporting agency.

1. What This Website Is

This private reference site is independent of all government offices. We do not store official records, conduct official checks, retrieve documents, or submit forms for a user.

Its content identifies the Saratoga County Sheriff's Office, New York courts, the New York State Division of Criminal Justice Services, and the New York State Sex Offender Registry as distinct official sources. Some pages also connect to outside research tools.

2. Rules for Using This Site

As a condition of access, you must not:

  • Interfere with site access or performance for other users
  • Use bots, scrapers, or other automated collection tools on these pages
  • Attempt to enter a system or area without authorization
  • Use site information to threaten, stalk, or harass a person
  • Rely on site content for hiring, housing, lending, or insurance decisions
  • Violate federal, New York, or local law through use of the site

3. No Harassment, Stalking, or Discrimination

You may not use information from this site or a linked tool to stalk, harass, intimidate, threaten, or unlawfully discriminate against anyone. New York Correction Law Article 6-C, including §168-q, restricts misuse of New York State Sex Offender Registry data and allows criminal consequences. Registry access supports public safety awareness. It does not authorize vigilantism or unlawful discrimination.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA and do not create consumer reports, credit reports, or official background checks. Neither we nor our advertising partners provides a service intended to assess applicants, renters, insurance risk, or creditworthiness. Information from the site or a linked tool must not be used to:

  • Set insurance premiums or assess creditworthiness
  • Evaluate a housing or rental application
  • Make a hiring or termination decision
  • Determine eligibility for a license, permit, or government benefit
  • Carry out any other activity regulated by the FCRA

A person with a regulated need must use an authorized official process or an FCRA-compliant provider.

5. No Legal Advice

Site content is not legal advice. General explanations of Saratoga County records cannot determine how a warrant, charge, conviction, or New York record sealing rule applies to an individual. A licensed New York attorney can provide that advice.

6. No Warranties

All content is supplied "as is." We make no promise that:

  • A partner tool will return complete or accurate results
  • The pages contain no bugs, mistakes, or security flaws
  • The site will remain available without interruption
  • Every fact is complete, accurate, and current at all times

Charges, dispositions, custody facts, and sealing status can change. Gaps and delays are possible. Nothing published here is an official statement from the Saratoga County Sheriff, a court, DCJS, or another agency.

7. Third-Party Services and Links

A link may lead to an official agency, court portal, legal resource, or outside search service that we do not control. We are not responsible for that service's availability, accuracy, price, content, or data practices. Review its terms before use.

8. Intellectual Property

Text, graphics, logos, and code belong to Saratoga County Criminal History or its content partners. Written permission is required before copying, changing, distributing, or creating derivative work from that material.

9. Limits on Our Liability

To the fullest extent permitted by law, we are not liable for damages arising from use of the site, its content, or a linked service.

10. Indemnification

You agree to indemnify and hold us harmless from claims, actions, demands, legal fees, and related costs caused by your site use or violation of these terms.

11. Governing Law

New York law governs these terms. A dispute related to use of the site must be brought in a court located in New York. Public agency records remain subject to New York Freedom of Information Law, Public Officers Law Article 6, while DCJS criminal-history dissemination is governed separately by Executive Law §837.

12. Changes to These Terms

We may revise these terms at any time. A revision takes effect when the new text is posted here.

13. Cutting Off Access

Access may be limited or terminated at any time, without notice and for any reason.

14. Severability

If one part of these terms is held invalid or unenforceable, the remaining terms continue in force. The affected part will be modified only as far as needed to make it enforceable.
